Indian Car Rental Terms & Conditions

These Terms & Conditions apply to bookings made with Indian Car Rental a unit of Aspark Holidays Pvt. Ltd. (“Aspark Holidays”, “the Company”, “we”, “us” or “our”) for vehicle rental, transportation, tours, accommodation and other travel-related services.

By confirming a booking and/or making an advance payment, the customer (“Client”, “you” or “your”) acknowledges and agrees to the applicable quotation, booking confirmation and these Terms & Conditions.

1. BOOKING & CONFIRMATION

A booking shall be considered confirmed only after:

  • The Client accepts the quotation/booking details.
  • The required advance payment has been received by Aspark Holidays.
  • An official Booking Confirmation has been issued by Aspark Holidays via email only.
  • Confirmation through WhatsApp, Telegram, SMS, Telephone, Social Media or any other mode of communication shall not be considered a valid booking confirmation.
  • All bookings are subject to availability at the time of confirmation.

Luxury Cars, Imported Luxury Vans (Mercedes & Toyota), Volvo/BharatBenz/Tata Luxury Coaches and other premium vehicles are limited in number and are booked on a first-come, first-served basis.


An enquiry, quotation or exchange of photographs/videos does not by itself constitute a confirmed booking.


2. ADVANCE PAYMENT

Unless otherwise specified in the quotation or booking confirmation, an advance payment of approximately 30% to 50% of the total booking value may be required to confirm a booking.

The exact advance amount applicable to a particular booking will be clearly specified in the quotation or booking confirmation.

Payment of the advance confirms the Client's acceptance of the booking terms, itinerary/service details and applicable Terms & Conditions.

3. BALANCE PAYMENT

The balance amount shall be payable according to the payment schedule specified in the applicable quotation or booking confirmation.

Unless otherwise agreed by Aspark Holidays in writing, the balance payment must be made on or before commencement of the services.

For certain multi-day bookings, Aspark Holidays may permit the balance payment to be made during the trip. Any such arrangement must be specifically mentioned or agreed in writing.

Bookings made within 7 working days of the commencement date may require full payment at the time of confirmation.

Hotel/resort bookings, airline tickets, railway tickets and certain third-party services may require full or non-refundable payment at the time of booking.

4. MODE OF PAYMENT

Payments may be made through the payment methods made available by Aspark Holidays, including:

  • Bank Transfer / Wire Transfer
  • IMPS / RTGS / NEFT
  • UPI or other approved domestic payment methods
  • Online Payment Link / Payment Gateway
  • Other methods specifically approved by Aspark Holidays


Online Payment Processing Charge

Payments made through an online payment link/payment gateway will attract an additional 5% payment processing charge.

The 5% processing charge applies only to payments made through the online payment link/payment gateway and does not apply to payments made through Bank Transfer / Wire Transfer / IMPS / RTGS / NEFT unless specifically stated otherwise.

Any intermediary bank, correspondent bank, foreign exchange or international wire-transfer charges shall be borne by the Client so that the full invoiced amount is received by Aspark Holidays.

5. CANCELLATION – GENERAL CONDITIONS

All cancellation requests must be submitted to Aspark Holidays in writing.

The effective cancellation date will be the date on which the written cancellation request is received by Aspark Holidays.

Cancellation charges are calculated according to the category of service/vehicle booked and the number of days remaining before the scheduled commencement of services.

A. Economy/Executive Cars

  1. 45 days or more before commencement: 25% of the Tour Advance Amount
  2. 30–44 days before commencement: 30% of the Tour Advance Amount
  3. 15–29 days before commencement: 50% of the Tour Advance Amount
  4. Less than 15 days before commencement: Cancellation charges may increase depending upon confirmed arrangements and supplier commitments.
  5. 7 days or less before commencement / No Show: 100% of the Tour Advance Amount


B. Luxury Cars/Imported Luxury Vans/Coaches/Buses

  • 45 days or more before commencement: 40% of the Tour Advance Amount
  • 30–44 days before commencement: 50% of the Tour Advance Amount
  • 15–29 days before commencement: 75% of the Tour Advance Amount
  • 08–14 days before commencement: Cancellation charges may be up to 100?pending upon vehicle allocation and supplier commitments.
  • 07 days or less before commencement / No Show: 100% of the Tour Advance Amount


6. MINIMUM CANCELLATION/SERVICE CHARGE

Once a booking has been confirmed, the minimum cancellation/service charge shall be 15% of the total booking value, irrespective of the cancellation slab.

This 15% is a minimum charge and is NOT an additional charge to be added over and above the applicable cancellation charge.

If the cancellation charge calculated under the applicable cancellation slab is higher than 15% of the total booking value, the higher applicable cancellation charge shall apply.

If the cancellation charge calculated under the applicable slab is lower than 15% of the total booking value, the minimum charge of 15% of the total booking value shall apply.

Any non-refundable amounts already paid or committed to hotels, transport operators, airlines, railways or other third-party suppliers may also be subject to their respective cancellation conditions where applicable.

7. REFUNDS

  • Where a refund is due under the applicable cancellation policy, the refundable amount will be calculated after deducting:
  • Applicable cancellation charges.
  • Non-refundable supplier charges, where applicable.
  • Bank/intermediary bank charges.
  • Payment gateway/online payment processing charges already incurred.


Any other non-recoverable amount specifically associated with the confirmed booking.

Payment gateway/online processing charges already incurred are non-refundable.

Approved refunds will normally be processed within approximately 3–4 weeks, subject to banking and payment-provider processing timelines.

Refunds will ordinarily be made to the person/account from which the original payment was received, wherever practicable.

8. CANCELLATION AFTER COMMENCEMENT/EARLY DEPARTURE

If the Client cancels, shortens or discontinues the trip after commencement of services, no automatic or proportionate refund shall be applicable.

Any refund, if possible, will depend upon amounts actually recoverable by Aspark Holidays from the relevant hotels, transport operators or other service providers.

No refund shall ordinarily be provided for voluntarily unused transportation, accommodation, sightseeing, meals or other services included in a confirmed booking.

9. VEHICLE PHOTOGRAPHS, VIDEOS & SPECIFICATIONS

Photographs and videos shared with a Client are intended to demonstrate the vehicle category, model/type, seating configuration, general interior specification and quality standard being offered.

Aspark Holidays operates and/or arranges multiple vehicles of similar categories and specifications. Unless a specific vehicle registration number has been expressly confirmed in writing for the service date, photographs/videos should not be interpreted as a guarantee of the exact individual vehicle or registration number shown.

Where a specific vehicle model/category, model year, seating capacity or other material specification is expressly committed in the final quotation or booking confirmation, Aspark Holidays will endeavor to provide the committed specification, subject to availability and the provisions relating to unforeseen circumstances and vehicle substitution below.

Minor differences in upholstery, accessories, entertainment systems, trim, interior layout or other non-material features may exist between individual vehicles of the same category.

10. VEHICLE COLOUR

Vehicle colour is subject to availability unless a particular colour has been expressly guaranteed in writing as part of the confirmed booking.

For conferences, events, delegations, weddings, VIP movements or other bookings where vehicle colour is important, the Client must communicate the colour requirement before confirmation.

A requested or preferred colour shall not constitute a guarantee unless Aspark Holidays expressly confirms it in writing.

11. VEHICLE ALLOCATION & REGISTRATION NUMBER

Final vehicle allocation and registration details may be provided closer to the service date.

Due to operational requirements, maintenance schedules, previous assignments, mechanical issues or other unforeseen circumstances, Aspark Holidays may not always be able to provide an exact registration number several weeks or months in advance.

A registration number communicated before final allocation shall be considered provisional unless expressly stated to be final and guaranteed.

12. SAME VEHICLE & DRIVER FOR MULTI-DAY TOURS

For multi-day tours, Aspark Holidays will normally endeavour to provide the same vehicle and driver throughout the confirmed tour, wherever operationally possible.

However, a change of vehicle and/or driver may become necessary due to:

  • Mechanical breakdown.
  • Accident or damage.|
  • Scheduled or emergency maintenance.
  • Driver illness, emergency or inability to continue duty.
  • Government, police or regulatory requirements.
  • Road or weather conditions.
  • Safety considerations.
  • Other circumstances beyond the reasonable control of Aspark Holidays.


Such a necessary substitution shall not by itself constitute cancellation of the booking by Aspark Holidays.

13. BREAKDOWN/VEHICLE SUBSTITUTION

In the event of a breakdown, mechanical problem, accident or other operational issue affecting the assigned vehicle, Aspark Holidays will make reasonable efforts to arrange a suitable replacement as quickly as practicable.

Where reasonably available, the replacement will be of the same or comparable category and standard.

However, an identical make, model, model year, colour, registration number, seating layout or interior specification cannot be guaranteed in an emergency replacement situation.

Where an equivalent vehicle is temporarily unavailable, Aspark Holidays may arrange the best reasonably available alternative in order to minimize disruption to the Client's journey.

14. ITINERARY & INCLUDED SERVICES

The quotation is based upon the itinerary, dates, timings, destinations, kilometres/hours and services specifically mentioned in the quotation or booking confirmation.

Any change requested by the Client after confirmation—including additional destinations, sightseeing, kilometres, hours, days, airport transfers, waiting time or other services—may result in additional charges.

Where a quotation specifically states that fuel, driver charges, tolls, parking and interstate taxes/permits are included, those items will be included for the confirmed itinerary and service limits only.

Additional expenses arising from changes to the confirmed itinerary or usage beyond the agreed limits will be charged separately.

15. GARAGE-TO-GARAGE CALCULATION

Where applicable, vehicle kilometres and duty hours will be calculated garage-to-garage, as specified in the quotation.

Extra kilometres, extra hours, night charges, interstate permits, tolls, parking or other charges shall apply where they are specifically excluded from the quoted package or where usage exceeds the confirmed service limits.

The Client may be requested to verify/sign the driver's duty slip or service record during the tour.

16. EXTRA USAGE OF VEHICLE

The vehicle shall be used only for the itinerary and service agreed at the time of confirmation.

Any additional usage requested by the Client will be subject to vehicle/driver availability and applicable additional charges.

The Client should not instruct the driver to materially change the itinerary, travel to an additional destination or exceed applicable duty limits without prior approval from Aspark Holidays.

17. CHANGES IN TAXES, FUEL OR GOVERNMENT CHARGES

If, after confirmation, there is a new or increased government tax, permit fee, toll, statutory levy, monument/entrance fee or other mandatory government charge that was not applicable or known at the time of quotation, the additional amount may be charged to the Client where applicable.

Material changes caused by extraordinary increases in fuel prices or other circumstances beyond the reasonable control of the Company will be communicated to the Client wherever applicable.

18. ITINERARY CHANGES DUE TO UNFORESEEN CIRCUMSTANCES

Road conditions, weather, traffic restrictions, natural disasters, political disturbances, government orders, strikes, demonstrations, landslides, floods, accidents or other circumstances may require changes to the scheduled itinerary.

Aspark Holidays reserves the right to make reasonable changes to an itinerary where necessary for passenger safety, comfort, legal compliance or operational feasibility.

19. THIRD-PARTY SERVICES

Where Aspark Holidays arranges hotels, airlines, railways, guides, attractions or other services provided by third parties, such services may also be subject to the respective supplier's terms, conditions and cancellation policies.

Aspark Holidays acts as an intermediary for such independently provided services where applicable.

20. DELAYS & CIRCUMSTANCES BEYOND OUR CONTROL

Aspark Holidays shall not be liable for delays, changes or additional expenses resulting from circumstances beyond its reasonable control, including but not limited to:

  • Severe weather or natural disasters.
  • Road closures or traffic restrictions.
  • Landslides or floods.
  • Strikes, riots or civil disturbances.
  • Government or police restrictions.
  • Flight or train delays/cancellations.
  • Accidents.
  • Vehicle or equipment breakdowns.
  • Epidemics/pandemics.
  • War or similar events.
  • Other force majeure circumstances.

Where possible, Aspark Holidays will provide reasonable assistance to minimise disruption.

21. COMPLAINTS DURING SERVICE

If the Client experiences any problem with a vehicle, driver or other service, the Client must inform Aspark Holidays as soon as reasonably possible during the service so that we have an opportunity to investigate and rectify the matter.

Where a problem could reasonably have been rectified during the trip but was not reported until after completion of the service, this may affect our ability to investigate or provide an appropriate remedy.

22. LUGGAGE & PERSONAL BELONGINGS

Clients are responsible for their luggage, valuables and personal belongings.

Aspark Holidays cannot accept responsibility for items left unattended or forgotten in a vehicle, except to the extent required by applicable law.

If an item is subsequently located, reasonable courier/delivery expenses for returning the item to the Client may be payable by the Client.

The Client should confirm luggage requirements before booking, particularly when travelling in luxury vans or vehicles with limited luggage capacity.

23. PASSENGER SAFETY & CONDUCT

Passengers must comply with applicable laws, safety requirements and reasonable instructions provided by the driver or Company.

The Client shall be responsible for any intentional or negligent damage caused to the vehicle by the Client or members of the travelling party, subject to reasonable evidence of such damage.

Smoking and any unlawful activity are prohibited inside vehicles.

24. TRAVEL INSURANCE

Clients are strongly advised to obtain suitable travel insurance covering, as appropriate, medical emergencies, accidents, trip cancellation/interruption, baggage loss and other travel risks.

Unless expressly stated otherwise, travel insurance is not included in the booking price.

25. QUOTATION & BOOKING CONFIRMATION TO PREVAIL FOR SPECIFIC SERVICES

These Terms & Conditions provide the Company's general booking conditions.

Specific commercial terms stated in an individual quotation, invoice or written booking confirmation—including the vehicle category, itinerary, inclusions/exclusions, payment schedule, cancellation terms, kilometres/hours and special requirements—shall apply to that particular booking.

Where a special term has been expressly agreed by Aspark Holidays in writing for a particular booking, that specific written term shall prevail over the corresponding general commercial term in these Terms & Conditions, to the extent of any inconsistency.

26. GOVERNING LAW & JURISDICTION

These Terms & Conditions and bookings made with Aspark Holidays Pvt. Ltd. shall be governed by the applicable laws of India.

Subject to applicable law, disputes arising from the booking or services shall be subject to the jurisdiction of the competent courts in Delhi, India.
